My Perfect Calendar Terms and Conditions

• Welcome to My Perfect Calendar! My Perfect Calendar provides members a fun, secure and easy way to print personalised calendars. However, before you enter the My Perfect Calendar site or use any of the My Perfect Calendar services, it is important that you carefully review the Terms and Conditions set out below.
• Terms may be changed or updated at any time, but you can always find the most recent version here. Therefore, as well as asking you to accept the Terms on first registering for the Site, we will ask you to accept the Terms again each time you purchase a new calendar.
• In the case of inconsistencies between these Terms and information included in off-line materials, (e.g., promotional materials), these Terms will always control. We suggest that you periodically check this page to make sure you are up to date.
• By entering and using the Site, you indicate that you accept the Terms and that you agree to be bound by and subject to them. Acceptance of the Terms creates a binding legal agreement between you and My Perfect Calendar that you will use the Service only in a manner that is consistent with the Terms. Your use of the Site and its services is entirely conditioned on and subject to your compliance with the Terms. If you do not agree with the Terms, do not proceed to access the Site or use the Service.

1. Terms of Membership

• My Perfect Calendar membership is available to you if you are at least 18 years of age and you submit certain requested information to My Perfect Calendar, including (but not limited to) your name and correct email address.
• Once you have registered, your membership will be live and you will be able to upload pictures and make calendars until such a time as your membership is terminated, either by yourself or by us (see Section 10: Termination)
• You will have to give your email address in order to open an account. Your email address will help us to verify your identity on future visits. In the event that you register using a non-existent email address or an email address that belongs to someone else, My Perfect Calendar may terminate your account without notice. You will need to provide a password by which you will be able to access the material that you have uploaded to the site.
• A condition of Membership is your "Active Participation". This is defined as purchasing calendars through the My Perfect Calendar Service at least once every 365 days. If your account is inactive for a period of over 365 days, My Perfect Calendar may terminate your Membership and use of the Service, and remove and discard any content, including but not limited to any and all information, image files or any other content within the Service. (see Section 10: Termination)

2. Member Conduct

• By accepting our Terms, users undertake not to use this Service to upload or store prohibited content. Generally, prohibited content includes (without limitation) any of the following types of content:

1. Content we believe is abusive, deceptive, pornographic, obscene, defamatory, slanderous, offensive, or otherwise inappropriate.
2. Copyrighted material that is used without the express permission of the owner.
3. Content that violates or encroaches on the rights of others.
4. Content or other material that contains viruses, worms, corrupt files, Trojan horses and other forms of corruptive code or any other content, which may compromise the My Perfect Calendar Service.

• My Perfect Calendar has the sole discretion to determine whether Content is prohibited content, and any content submitted to the Service may be subject to examination from time to time and has the right to delete any materials for any reason, at any time, without notice if it considers them to breach Terms.
• No Resale of Service - You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the service, or access to the Service for any commercial purposes.
• Third Party Software - As a convenience to our Members, we may make third-party software available through the Service. To use the third-party software, you must agree to the terms and conditions imposed by the third party provider and the agreement to use such software will be solely between you and the third party provider. By downloading third party software, you acknowledge and agree that My Perfect Calendar does not guarantee that any software downloaded through the Service will be free of viruses, worms, or Trojan horses or other forms of corruptive code. My Perfect Calendar makes no representations or warranties concerning the performance, effectiveness or any other aspect of any third-party software downloaded through the Service. In no event shall My Perfect Calendar (including its officers, directors, employees, affiliates and agents) be liable for claims of any nature, whether direct or indirect, arising from or related to any third-party software downloaded through the Service.

3. Privacy Policy

• We respect your privacy and have taken specific steps to protect it. Please see our Privacy Policy.

4. Order Process

• Please see the Help section for information on how to place an order for a calendar. All orders that you place on the Site will be subject to the acceptance in accordance with these terms and conditions.
• We do not file details of your order for you to subsequently access direct on this website, and therefore, please print out these terms and conditions and the order acknowledgement for your own records. If you wish to obtain specific details of your previous orders please contact us.

5. Delivery

• This website is only for the delivery of products to customers in mainland UK and Northern Ireland addresses. We cannot deliver to the Channel Islands, Isle of Man, Orkney, Shetland and Scottish Islands, BFPO addresses, or the Republic of Ireland. All goods are sent out recorded delivery by Royal Mail and will need to be signed for.
• Delivery charges and estimated timescales are specified in the Help section. They will also be confirmed to you during the "Check-out" process before we ask you for any payment. We make every effort to deliver the goods within the estimated timescales; however delays are occasionally inevitable due to unforeseen factors. My Perfect Calendar shall be under no liability for any delay or failure to deliver the products within the estimated timescales.

6. Payment

• Payment can be made by any method specified in the Help section.
• Title to products you order through this website shall pass to you on delivery of the products, provided that we have processed and received payment in full for the products.
• We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are proven negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

7. Returns and Cancellations

8. Copyright

• You retain all intellectual property rights, including copyright, to the pictures that you have uploaded to the web site.
• We may delete, remove or refuse to display any material from your photo album at our sole discretion.
• We may display, modify, print, or delete any of the images that you upload, provided that this use is necessary in order to provide any of the services offered by us via the web site.
• My Perfect Calendar is unable to provide you with permission to copy, display or distribute material for which you do not own the copyright, and we do not provide others with such rights to your Content. You may not copy or distribute such material without the written consent of the copyright owner, and you are solely responsible for any copyright violations that you may incur as a result of your activities on the Service. My Perfect Calendar has the absolute right to terminate your membership or exclude you from the Site if you use our Service to violate the intellectual property rights of third parties.

9. Operation of the My Perfect Calendar Website

• We may change the format and content of the web site (or any products or services offered by this web site) at any time.
• We may terminate or suspend the operation of this web site (or terminate or suspend provision of any products or services offered via this web site) for support or maintenance work, in order to update the content or for any other reason. We may do this at any time and without notice.
• You are advised to keep back ups of all material provided to us. In particular, it is up to you to keep backup copies of images uploaded by you or emailed to us. We will not be responsible for keeping backups or for loss of, deletion or corruption of any images or any other material.

10. Termination

• You agree and acknowledge that My Perfect Calendar, in its sole discretion, may terminate your Membership (or any part thereof) or use of the Service, and remove and discard any Content including, but not limited to, any and all information, image files or any other content within the Service, at any time, without notice, for any reason, including but not limited to:

1. Conduct violating these Terms or other policies or guidelines set forth by My Perfect Calendar elsewhere on the Site;
2. Conduct that My Perfect Calendar believes is harmful to other My Perfect Calendar users, the business of My Perfect Calendar, or other third party information providers;
3. Failure to continue Active Participation; and
4. Conduct that violates the letter or spirit of these Terms.

• Further, you agree that My Perfect Calendar shall not be liable to you or any third-party for any termination of your access to the Service.
